Privacy Policy

1. Introduction

This Privacy Policy explains how 9th Ward Production & Promotions Company, LLC, a Texas limited liability company doing business as 9th Ward ("9th Ward," "we," "us," or "our"), collects, uses, and shares information when you visit our website at https://www.9thwardproductions.com and use its forms and features (the "Site").

By using the Site, you agree to this Privacy Policy. If you do not agree, please do not use the Site. This Policy is part of, and incorporated into, our Terms of Service.

2. Information We Collect

We collect only what we need to run the Site and respond to you. We do not require you to create an account, and the Site does not process payments.

2.1 Information you give us

When you use a form on the Site, you choose what to send us. Depending on the form, this may include:

  • Artist / music submissions: artist or band name, your name, email address, phone number (optional), genre, city, links to your music, links to your social profiles, and any message you include.
  • Contact messages: your name, email address, subject, and message.
  • Booking requests: your name, email address, phone number (optional), the artist requested, event date, venue or city, budget, and details.
  • Service inquiries: your name, email address, phone number (optional), the service you're interested in, your artist or project name, and details.
  • Newsletter sign-ups: your email address.

Please don't send us sensitive personal information (for example, government ID numbers, financial account numbers, or health information) — we don't need it and don't ask for it.

2.2 Information we collect automatically

When you visit the Site, our hosting provider and systems may automatically log limited technical information, such as your IP address, browser type, device and operating system, referring page, and the date and time of your request. We use your IP address on a short-term basis to protect the Site from spam and abuse (for example, rate-limiting form submissions).

2.3 Analytics

If enabled, we use Plausible Analytics, a privacy-friendly analytics tool, to understand overall Site traffic and which pages are popular. Plausible is designed to measure traffic without using cookies and without collecting personal data or tracking you across websites. It reports aggregated, anonymized statistics only.

2.4 Cookies and local storage

The Site uses minimal browser storage. It may store a small preference on your device to remember your light/dark display choice. We do not use advertising cookies or third-party tracking cookies. Embedded third-party content (see Section 6) may set its own cookies when you interact with it.

2.5 Embedded content from other sites

Some pages embed content from third parties (for example, YouTube, Spotify, SoundCloud, Bandcamp, or Apple Music players). These embeds can collect information about your interaction with them and may set their own cookies, exactly as if you visited the third party's own site. We don't control that. See Section 6.

3. How We Use Information

We use the information we collect to:

  • respond to your messages, submissions, booking requests, and inquiries;
  • evaluate artist and music submissions;
  • send our newsletter and updates to people who ask for them;
  • operate, maintain, secure, and improve the Site, including preventing spam, fraud, and abuse;
  • understand aggregate Site usage through privacy-friendly analytics; and
  • comply with law and enforce our Terms of Service.

We do not use your information for automated decisions that produce legal or similarly significant effects about you, and we do not sell your personal data.

4. How We Share Information

We do not sell your personal data, and we do not share it for cross-context behavioral (targeted) advertising. We share information only as described here:

  • Service providers (processors). We use trusted vendors to run the Site on our behalf, under contracts that limit their use of your information to providing services to us. These currently include:
  • Airtable — stores the information you submit through our forms;
  • Resend — delivers email notifications to us (and, where applicable, to you);
  • Railway — hosts the Site; and
  • Plausible — provides privacy-friendly, aggregated analytics (if enabled).
  • Legal and safety. We may disclose information if required by law, subpoena, or legal process, or if we believe in good faith that disclosure is necessary to protect our rights, your safety or the safety of others, or to investigate fraud or abuse.
  • Business transfers. If 9th Ward is involved in a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction. We will require the recipient to honor this Policy or notify you of material changes.

5. How Long We Keep Information

We keep the information you submit for as long as needed to respond to you, to pursue a possible working relationship, and to keep reasonable business records — and then for as long as needed to comply with law, resolve disputes, and enforce our agreements. Newsletter data is kept until you unsubscribe or ask us to delete it. When information is no longer needed, we delete it or destroy the records in a reasonable manner, consistent with Texas Business & Commerce Code § 521.052.

6. Third-Party Links and Platforms

The Site links to and embeds third-party services, and our artists maintain profiles on platforms we don't control (for example, YouTube, Spotify, Apple Music, SoundCloud, Bandcamp, Facebook, and others). This Privacy Policy does not cover those services. When you click a link or interact with embedded content, the third party's own privacy policy governs. We encourage you to review it.

7. How We Protect Information

8. Email Communications

If you subscribe to our newsletter or otherwise ask to hear from us, you can opt out at any time by using the unsubscribe link in our emails or by contacting us at info@9thwardproductions.com. We honor opt-out requests promptly, and in all cases within 10 business days, consistent with the federal CAN-SPAM Act (15 U.S.C. § 7704). We may still send you non-marketing messages needed to respond to a request you made.

9. Your Privacy Rights (Texas Residents)

If you are a Texas resident, the Texas Data Privacy and Security Act (Texas Business & Commerce Code Chapter 541, the "TDPSA") gives you the right, subject to its conditions and exceptions, to:

  • Confirm and access whether we process your personal data and get a copy of it;
  • Correct inaccuracies in your personal data;
  • Delete personal data we hold about you;
  • Obtain a portable copy of personal data you provided to us, where technically feasible; and
  • Opt out of the processing of your personal data for (a) targeted advertising, (b) the sale of personal data, or (c) profiling that produces legal or similarly significant effects.

How to exercise your rights. Email us at info@9thwardproductions.com with your request and enough information for us to locate your data and verify your identity. We do not charge for a first request in a 12-month period. We will respond without undue delay and within 45 days of receiving your request. When reasonably necessary, we may extend that period once by an additional 45 days and will tell you why within the first 45 days.

As a note on our practices: we do not sell personal data, do not use it for targeted advertising, and do not use it for profiling with legal or similarly significant effects — so there is nothing to opt out of in those categories. We also do not use or disclose sensitive personal data for these purposes.

Appeals. If we decline to act on your request, we will tell you why. You may appeal that decision by replying to our response or emailing info@9thwardproductions.com with the word "Appeal." We will respond to your appeal in writing within 60 days. If we deny your appeal, you may contact the Texas Attorney General to submit a complaint at the Texas Attorney General's website (https://www.texasattorneygeneral.gov).

10. Residents of Other States and Countries

If you live outside Texas, other privacy laws may give you similar rights (for example, in California or the European Union / United Kingdom). We aim to honor reasonable requests to access, correct, or delete your personal data regardless of where you live. com**.

The Site is operated from the United States; if you access it from elsewhere, you understand your information will be processed in the United States, where privacy laws may differ from those where you live.

11. Children's Privacy

12. Do Not Track

Some browsers send "Do Not Track" signals. There is no common industry standard for responding to them. Because we do not track you across third-party websites for advertising, our practices do not change based on these signals.

We may update this Privacy Policy from time to time. When we do, we will change the "Last Updated" date above and, for material changes, take reasonable steps to notify you (for example, a notice on the Site). Your continued use of the Site after an update means you accept the revised Policy.
